1. Acceptance of Terms By scheduling or receiving services from Jaini PowerWash, you agree to the following Terms of Service. These terms form a legal agreement between you (the “Customer”) and Jaini PowerWash (the “Company”). Please read them carefully.
2. Service Scope Jaini PowerWash provides exterior house washing services. The company will use water and cleaning agents to clean the exterior surfaces of homes. Any additional services must be agreed upon in writing and may incur additional charges.
3. Estimates and Payment The Company will provide an estimate prior to commencing work. The Customer agrees to pay the full amount of the estimate upon completion of services. The Company reserves the right to modify pricing if unforeseen conditions or additional services are required, with the Customer’s consent.
4. Property Condition The Customer is responsible for ensuring that all property is in a condition suitable for pressure washing, including but not limited to proper sealing of windows, doors, and electrical outlets. The Company will not be liable for damages caused by existing structural defects, improperly installed equipment, or water intrusion due to faulty property features.
5. Use of Chemicals Jaini PowerWash may use chemicals and detergents in accordance with safety standards. The Customer agrees that the Company is not responsible for any damage caused by cleaning agents unless it is proven that the chemicals were used inappropriately.
6. Limitation of Liability The Company will take all necessary precautions to avoid damage to the Customer’s property. However, Jaini PowerWash is not liable for:
- Pre-existing damage, including but not limited to chipped paint, faulty wiring, or worn materials.
- Damage to plants, landscaping, or exterior fixtures.
- Any claims arising from Customer’s failure to follow instructions regarding the maintenance or preparation of property.
7. Weather Conditions The Company reserves the right to reschedule services due to weather conditions that may affect safety or the quality of the service provided. The Company will not be held liable for delays due to such conditions.
8. Cancellation Policy Customers may cancel or reschedule their appointments at least 24 hours before the scheduled service time. Cancellations made with less than 24 hours' notice may result in a cancellation fee.
9. Warranty and Disclaimers The Company guarantees the quality of its work for a period of 7 days after completion. Any issues related to the work must be reported within this period. The Company is not liable for any damage or defects caused after this period or due to external factors such as weather, vandalism, or improper maintenance.
10. Indemnification The Customer agrees to indemnify, defend, and hold harmless Jaini PowerWash, its employees, and subcontractors from any and all claims, damages, or legal actions arising out of the services provided, except in cases of gross negligence or intentional misconduct by the Company.
11. Governing Law These Terms of Service are governed by the laws of the State of Texas. Any disputes will be resolved in the courts of Travis County, Texas.
